UK Immigration and Work Permits

There are many different types of visa and work permits available for people wanting to come over to the UK to work or who are currently here on a temporary basis and want to remain for a longer period of time to work. Eligibility to a visa or work permit often depends on the individual’s circumstances and there is often a set of criteria that has to be met for each one.

Many people wanting to enter the UK or remain in the UK to work are unaware of what their options are in regards to getting a work permit. People who enter the UK on working Holiday Maker visas often end up wanting to remain in the UK at the end of the term of this visa and want to find out how they can do this.

 European Economic Area/European Union Nationals

You are a national of the European Economic Area if you are a national of one the following countries:-

 

  • Austria
  • Belgium
  • Cyprus
  • Czech Republic
  • Denmark
  • Estonia
  • Finland
  • France
  • Germany
  • Greece
  • Hungary
  • Iceland
  • Irish Republic
  • Italy
  • Latvia
  • Liechtenstein
  • Lithuania
  • Luxembourg
  • Malta
  • Netherlands
  • Norway
  • Poland
  • Portugal
  • Slovakia
  • Slovenia
  • Spain
  • Sweden

Although Iceland, Liechtenstein and Norway are not members of the European Union, the European Economic Area Agreement gave nationals of these countries the same rights to enter, live in and work in the United Kingdom as EU citizens. Under the 2006 Regulations Swiss nationals are included in the definition of "EEA nationals".

Since 1 May 2004 nationals from the Czech Republic, Estonia, Hungary, Latvia Lithuania, Poland, Slovakia and Slovenia who take up employment in the United Kingdom are required to register with the Home Office under the 'Worker Registration Scheme'. Failure to register within one month of starting a new job and getting a registration certificate could deem the employment as being illegal.

You need to register with the Home Office if:

- You are a national of one of the new Member States (excluding Malta and Cyprus) subject to the WRS

- You start a new job on or post 1 May 2004

- You have been working in the UK prior to 1 May 2004 without permission from the Home Office.
